General terms and conditions of contract

This section establishes the contracting and acquisition of products through the website https://www.ansaperansa.com, owned by ANSA PER ANSA MENORCA, SL, hereinafter Ansa Per Ansa .

By accepting this contract, the consumer and/or user (hereinafter referred to as the client) agrees to the following:

  1. That is, a person with sufficient capacity to enter into a contract.
  2. That he/she has read, understands and accepts without reservation each and every point of these general terms and conditions of contract.
  3. That it assumes all established obligations.

Ansa Per Ansa does not process data relating to minors. Ansa Per Ansa only sells to adults in accordance with Spanish law (Article 315 of the Civil Code).

These conditions will be valid indefinitely and will apply to all contracts made through the website www.ansaperansa.com.

Ansa Per Ansa reserves the right to modify the contractual offer, consisting of these general conditions and the list of products and their prices, at any time, although these modifications will not apply to contracts already entered into by the consumer and/or user. Therefore, it is recommended to read them before purchasing any product/service offered.

IDENTITIES OF THE PARTIES

On the one hand, Ansa Per Ansa Menorca SL (owner of the website www.ansaperansa.com) with Tax ID number: B-16668154, as the supplier of the products contracted by the consumer and/or user, with registered office at Carrer Josep Maria Quadrado, 17 - 19, 07760 Ciutadella de Menorca, Illes Balears (Spain). On the other hand, the client, whose purpose is to be a consumer and/or user of the same and/or to contract the products or services of Ansa Per Ansa .

Communications made between the client and Ansa Per Ansa through these means shall be considered effective and valid for all purposes.

CUSTOMER RESPONSIBILITY

The customer undertakes to make lawful use of the website and the services provided therein, respecting current legislation and refraining from infringing the rights and interests of third parties and Ansa Per Ansa.

The client is responsible for the accuracy of the data provided to Ansa Per Ansa and therefore is liable for any consequences that may arise from providing false or erroneous data on this website.

The customer must respect and accept the general terms and conditions, the legal notice, the terms of use and the privacy policy established on this website.

Failure to comply with the above may result in the withdrawal or cancellation of services by Ansa Per Ansa without prior notice and without entitling the client to any compensation, as well as the initiation of legal action to which Ansa Per Ansa is entitled.

ANSA'S RESPONSIBILITY PER ANSA

Ansa Per Ansa undertakes to respect the obligations set out in these general terms and conditions of contract.

LANGUAGE

The language in which the relationship with the customer is perfected will be Spanish.

SUBJECT MATTER OF THE CONTRACT (DESCRIPTION OF THE PRODUCTS)

The purpose of this contract is to regulate the relationship between Ansa Per Ansa and the client at the moment the client gives their consent during the contracting process by accepting the corresponding box. (This box will inform the client about these general terms and conditions of contract before acceptance.)

The contractual relationship of purchase and sale will entail the delivery of a product in exchange for a price determined on the website.

PROCUREMENT PROCEDURE

Ansa Per Ansa products can be purchased in the following ways:

Please note that, in accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow these steps:

1. Registration (optional)

In order to simplify the purchasing process as much as possible, the user can register through a form provided for this purpose in the "USERS" section, or when making a product purchase.
To register, you will need to create a user account. To do so, the user must freely and voluntarily provide the requested personal data.

The user will select a username and password, undertaking to use them diligently and not to make them available to third parties, as well as to inform the provider of their loss or theft or of possible access by an unauthorized third party, so that the provider can proceed to immediate blocking.

The user may not choose as a username words intended to mislead others by identifying the user as a member of the provider, as well as offensive, insulting expressions and, in general, those contrary to the law or the demands of morality and good customs.

Notwithstanding the foregoing, the user may have the option of making the purchase without registering on the platform.

2. Product selection and purchase

The different product types are displayed in the upper central area.

  1. Click on the desired category and choose the product you wish to purchase. A descriptive sheet will then appear detailing its characteristics and price including VAT.
  2. If the selected product is not available in stock, it will be explicitly indicated and cannot be added to the "cart".
  3. To add the desired available product to the "cart," click on the "buy" or "Add to Cart" link. The purchase menu will then appear, where the user can see the total purchase price and cancel the purchase via the "Delete" command.
  4. Once the products to be purchased have been selected, the buyer must complete a form if they have not registered previously. This completion is for the purpose of carrying out the shipment, invoicing, and managing their personal data.
  5. Once the purchase process is complete, a summary of the previous process will appear with the information provided, so that you can either correct any data or confirm your order.
  6. You will make the payment for the product according to the selected procedure.
  7. The purchase is complete.
  8. Once the purchase has been made, Ansa Per Ansa will send a purchase receipt by email within a maximum of 24 hours.

PRODUCTS / SERVICES OFFERED

The main features of each product are described in their corresponding product pages or sections. (Features, price, offers, discounts, etc.).

The offers will be duly marked and identified as such, conveniently indicating the previous price and the offer price.

The sale of products will only take place in Spanish territory, specifically in the Iberian Peninsula and the Balearic Islands, with the rest of the territories being expressly excluded.

PRICE AND VALIDITY PERIOD OF PRODUCTS

The customer accepts that the economic valuation of some products may vary in real time. Consequently, the price applied will be the one in effect on the date the order is placed. However, this final price will be communicated to the customer during the electronic purchase process, beforehand and before the customer proceeds to formalize their acceptance of the purchase.

The prices indicated for each product include Value Added Tax (VAT) and will in all cases be expressed in Euros (€).

VAT tax rates may vary depending on the destination country and the nature of the products in the order.

The prices shown for the products do not include shipping costs, shipping insurance, or any other additional services related to the purchased product, unless expressly stated otherwise.

Notwithstanding the foregoing, the customer may check and calculate the total price of the product with the exact breakdowns before proceeding to formalize the payment in the website's purchase process.

PAYMENT METHOD

  1. By credit card. Using this payment method, the customer will need to provide their card number, expiry date, and CVV number. In this case, their data will be encrypted and sent securely to the bank's virtual POS (Point of Sale) terminal. This procedure does not provide Ansa Per Ansa with the card number.
  2. Via PayPal : For customers to pay for their purchases using this system, they must have a PayPal account. For more information, visit www.paypal.es .

ORDER LEAD TIMES AND DELIVERY

The product will be considered delivered to the customer at the moment it is available to the customer and the customer signs for its receipt at the transport agency/post office.

Orders will be delivered to the delivery address freely designated by the customer during registration/purchase process, once payment has been executed and confirmed.

In no case will Ansa Per Ansa be held responsible if the product delivery fails to take place as a consequence of the customer providing false, inaccurate or incomplete data, or when the delivery cannot be made due to causes beyond the control of the entity responsible for the shipment, such as the absence of the recipient.

Deliveries will be made by the company:

  • MRW

Orders received before 2 PM will be shipped that same afternoon. Orders received after that time will be shipped the following day.

Saturdays, Sundays, and public holidays in Spain will not be counted towards these deadlines.

It is possible that delivery may be delayed beyond the set deadlines; in this case, Ansa Per Ansa will take the measures required of a diligent merchant to ensure delivery is made within the agreed time, and if this is not possible, within a maximum period of 30 calendar days from the purchase of the product, as specified by current legislation on consumer protection (art. 109).

If, despite this, the product is still not delivered, the buyer has the right to demand that Ansa Per Ansaa comply within an additional period appropriate to the circumstances. If the seller does not deliver the goods within this additional period, the customer will have the right to terminate the contract, and the seller must refund, without undue delay, all amounts paid by the buyer under the contract.

SHIPPING COSTS

The rates used to calculate shipping costs depend on the region to which the product is to be sent. Therefore, these costs cannot be calculated in advance; the following table serves as a reference:

  • Orders to mainland Spain and the Balearic Islands with free shipping: Delivery by MRW.

This data will be provided by the client at the time of registration via the form.

Once the order has been placed and its amount confirmed, the system will calculate the shipping costs. The customer can check the invoice at any time on their screen, which will show a breakdown of the order and shipping costs.

CLAIM FOR UNDELIVERED ORDERS:

After receiving an email confirming that their order has been shipped, if the customer does not receive the product within a reasonable timeframe, they can contact Ansa Per Ansa by phone at (+34) 645 84 44 30, via the "Contact" form, or by email at hola@ansaperansa.com to clarify the reason for the delay.

Once the claim has been received, Ansa Per Ansa will contact the client to explain what happened and reach an agreement on the matter.

CANCELLATIONS

If, after making a purchase, you wish to cancel an order that has not yet been shipped , you can do so provided you indicate this using the contact form provided in the "Contact" section, or in writing to the email address hola@ansaperansa.com , the customer service form, or by phone at (+34) 645 84 44 30, stating the order number you wish to cancel.

FORCE MAJEURE

Neither party shall be liable for any breach due to force majeure. The termination of the contract shall be postponed until the force majeure situation ends.

RIGHT OF WITHDRAWAL

The consumer and/or user will have a period of 14 calendar days from the date of receipt of the product to return it without needing to state the reason and without incurring any cost.

The product must be returned in perfect condition without limiting the use of the product (provided that it does not go beyond merely checking its good condition and operation).

The consumer is expressly informed that they will have to pay the shipping costs for the return of the goods when exercising their right of withdrawal.

The following exceptions to the right of withdrawal are established and expressly included in the Law on Consumer and User Protection, which are, among others:

  • The supply of goods manufactured according to the specifications of the consumer and/or user, or clearly personalized.
  • The supply of goods which, after delivery and having regard to their nature, have become inextricably mixed with other goods.
  • The supply of digital content which is not provided on a tangible medium when the performance has begun with the prior express consent of the consumer and/or user, with the knowledge on their part that they consequently lose their right of withdrawal.

Procedure:

To exercise their right of withdrawal, the consumer and/or user has a period of 14 calendar days from receipt of the product. To do so, they must complete the form provided in the "Contact" section.

Regardless of the method used, your communication must contain the following information:

  • Your identifying information: full name and address
  • Order number that appears on the invoice that was sent to you along with the purchased item.
  • Description of the acquired asset
  • Their willingness to withdraw from the purchase agreement.
  • Bank account where you want the price and costs to be refunded.
  • Date of communication
  • If you submit your request by non-electronic means (for example, postal mail), it must be signed.

From the date on which you communicate your decision to withdraw from the contract, the consumer and/or user has a period of 14 calendar days to return the purchased goods to Ansa Per Ansa in perfect condition, along with a copy of the purchase invoice.

Ansa Per Ansa will promptly notify the consumer and/or user via email of receipt of the withdrawal, including instructions for the return shipment by the consumer and/or user. Once the product has been received or the consumer and/or user has provided proof of return, Ansa Per Ansa will refund the sums paid by the consumer and/or user without undue delay .

APPLICABLE WARRANTIES

The contractual guarantee offered is that established in Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users. Ansa Per Ansa will be liable for any lack of conformity that manifests itself within two years of delivery, provided that the customer has informed Ansa Per Ansa of such lack of conformity within two months of becoming aware of it. In the case of a defective product, the seller will proceed, as appropriate, with repair, replacement, price reduction, or contract termination.

COMPLAINT FORMS

At the address Carrer Josep Maria Quadrado, 17 - 19, 07760 Ciutadella de Menorca, Illes Balears (Spain), the consumer and/or user has access to complaint forms, as established by the competent regulations in this matter. Notwithstanding the foregoing, the consumer and/or user may, in any case, request the sending of these forms via the contact form established for this purpose in the "Contact" section or to the email address hola@ansaperansa.com .
